General Terms and Conditions
Article 1 (Purpose)
The purpose of this Agreement is to prescribe the legal and contractual relationship between SCHAUPLATZ LTD. (“Schauplatz”) and its customers when Schauplatz provides tailor made travel or other services.
- These general terms and conditions of contract and travel apply for the general cases, except those described below.
Ⅰ. for all “flight-only arrangements” provided by Schauplatz, the general terms and conditions of contract and carriage of the airlines apply.
Ⅱ. If Schauplatz provides you with travel arrangements or certain services from other organizers or service providers, their own terms and conditions of contract and travel apply. In such cases, Schauplatz is not a party to the contract and you cannot therefore rely on these general terms and conditions of contract and travel.
Article 2 Definitions
- “Journey” refers to the holistic experience offered by Schauplatz, which may include elements of Tailor-Made Travel, Life, and Photography. It encompasses physical travel, emotional exploration, creative development, and personal transformation aligned with Schauplatz’s philosophy.
- “Life” refers to the classification of services Schauplatz provides its customers for a specific experience, such as workshops, tours, events, exhibitions, photo shoots and photo colloquiums.
- “Photography” refers specifically to services related to photography, including photo workshops, visual experiences, and photography-focused events.
- “Travel” refers to travel in a general sense and includes but is not limited to transportation, accommodation, and logistics.
- “Tailor-Made” refers to customized services designed to meet the specific needs or preferences of the customer, offering personalized experiences aligned with Schauplatz’s philosophy.
- “Customer” refers to any person or legal entity seeking to purchase or otherwise engage with services offered by Schauplatz, including but not limited to participation in Tailor-Made Tours.
Article 3 Types and Definitions of Tours (Schauplatz Journeys)
- “Tour” means any travel experience, itinerary, or journey organized by Schauplatz. The Organizer reserves the right to define group size limits and specific arrangements per Tour.
- Domestic Tour: A Tour that takes place entirely within the Republic of Korea (“Korea”).
- International Tour: A Tour that takes place outside the territory of Korea.
- Private Tour: A Tour that is exclusively designed for a single customer or their group, with a customized itinerary and no third-party participants.
- Small Group Tour: A Tour with a limited number of participants, following a customized itinerary.
Article 4 Obligations of Schauplatz and Customers
- Schauplatz shall faithfully establish and implement a Tour plan, which includes recommendations, introductions, transportation, accommodations, etc., so as to provide a safe and satisfying Tour for its Customers.
- Customers shall fully cooperate with Schauplatz in Schauplatz’s efforts to facilitate unity between Customers and maintain order during the Tour, so that the Tour is safe and enjoyable.
Article 5 Agreements
- A Tour consists of the Tour Agreement (i.e., these General Terms and Conditions) and a Tour Schedule (Itinerary or Guidebook).
- Schauplatz may enter into additional written agreements with the Customer, provided they do not conflict with applicable law.
- For International Tours, Schauplatz shall provide relevant safety information as published by the Korean Ministry of Foreign Affairs (www.0404.go.kr) at the time of entering into the Tour Agreement.
Article 6 Delivery of Agreement and Terms
- Upon entering into a Tour Agreement, Schauplatz shall provide the Customer with one copy each of the Tour Agreement and the Tour Schedule (Itinerary or Guidebook).
- Delivery is also deemed complete when the Customer consents in writing to the Tour Agreement and Tour Schedule provided via electronic or mechanical means (e.g., the Schauplatz website, email, or facsimile), submits a booking request, and receives confirmation from Schauplatz through the same or equivalent means.
- The agreement is concluded upon written or electronic confirmation. Digital signatures or checkboxes as valid confirmations.
Article 7 Schauplatz Responsibilities
- Schauplatz is liable for any damage caused to the Customer through intent or negligence by Schauplatz or its employees, in connection with its obligations under Article 4 Paragraph ①.
- However, Schauplatz is not liable for damage caused by third-party agencies or service providers with whom the Customer has a separate agreement.
- In the case of non-physical (financial or material) damage caused under Paragraph ①, Schauplatz’s liability is limited to the amount paid for the Tour.
Article 8 Customer Responsibilities
- Customers are responsible for the proper use and care of any tools or devices provided by Schauplatz during a Tour. Any damage or contamination due to misuse shall be the Customer’s responsibility.
- Schauplatz is not liable for any accidents involving the Customer, including theft, loss, or damage to personal belongings during the Tour.
- Customers are solely responsible for complying with all health regulations issued by local or international authorities. This includes, but is not limited to, quarantine rules, vaccination requirements, and repatriation protocols.
- Schauplatz may offer general travel guidance, but the decision to travel and the obligation to stay informed rests solely with the Customer. Health-related disruptions, including cancellations, do not entitle the Customer to refunds beyond what is specified in these Terms.
- Health regulations and travel advisories may change without notice and are typically issued by public authorities, such as the Korean Ministry of Health and Welfare. Customers must verify all requirements before and during travel.
- Schauplatz is not responsible for disruptions caused by events beyond its control, including but not limited to natural disasters, political unrest, epidemics, strikes, or government restrictions. Any resulting changes, delays, or extra costs are borne by the Customer.
- No compensation or refund will be issued for disruptions due to force majeure unless explicitly stated in these Terms.
- Customers are strongly encouraged to obtain comprehensive travel insurance that covers events such as cancellations, delays, medical emergencies, and evacuations.
- Complaints regarding issues not covered in the Tour Agreement must be submitted in writing within one (1) month of the Tour’s end date. Late submissions will not be accepted.
Article 9 Cancellation Due to Minimum Participant Requirements
- Domestic Tours:
Ⅰ. Schauplatz may cancel the Tour or modify the schedule and content if the minimum number of participants is not met.
Ⅱ. If this occurs within 30 days of departure, Customers may switch to another Tour. Customers wishing to proceed with the original Tour must notify Schauplatz, who may make a new offer.
Ⅲ. If a Tour is canceled due to low participation or force majeure, customers will be informed.
– a. At least 24 hours before a one-day Tour;
– b. At least 72 hours before a multi-day Tour.
In such cases, a refund will be issued minus non-recoverable costs (e.g. admin or supplier fees).
Ⅳ. If Schauplatz fails to notify within the required timeframe, it will refund all payments and compensate for additional reasonable costs, excluding non-recoverable expenses. - International Tours:
Ⅰ. Schauplatz may cancel or modify an International Tour if the minimum number of participants is not reached.
Ⅱ. If this occurs within 30 days of departure, Customers may choose a different Tour or request an offer for the original Tour.
Ⅲ. Customers must be informed of cancellation at least 7 days before departure. Full refunds (minus non-recoverable costs) will be provided.
Ⅳ. If cancellation occurs with insufficient notice:
– a. 1 day before departure → 30% of the Tour fee is paid as compensation.
– b. Same day cancellation → 50% of the Tour fee is paid as compensation.
Article 10 Refusal to Execute Agreement
In any of the following cases, Schauplatz may refuse to execute any agreement with a Customer:
- when it is acknowledged that the Customer has caused trouble for other customers or has interrupted the successful implementation of a Tour;
- when it is acknowledged that the Customer cannot continue with the Tour because of illness or other causes; or
- when the Tour desired by the Customer has reached the maximum number of participants (to assure customer experience, satisfaction and enjoyment).
Article 11 Fees
- Tour-related fees in the Tour Agreement may include the following:
① Transportation fare (for normal travel by airplane, ship, train and/or others)
② Transportation fare (in between airports, train stations, ports and/or hotels)
③ Accommodation and meals
④ Tour guide and expert fee
⑤ All taxes required during the Tour
⑥ Fees for domestic airports and ports
⑦ Entrance fees to Tour destinations included in the schedule
⑧ Contribution to the Tourism Promotion and Development Fund
⑨ Other expenses arising from individual agreements. *
*Customers are responsible for any additional costs incurred due to personal requests, custom arrangements, or services not included in the standard Tour package. These may include, but are not limited to, itinerary modifications, upgraded accommodations, private transfers, or extended stays. - The Customer must pay Schauplatz the contract deposit*(30% of Tour fee) at the time the agreement is executed, which shall be deemed as a partial amount of the Tour fee or compensation for damage.
*30% non-refundable deposit at the time of confirmation, final balance is due 60 days prior to departure (i.e. Start of the Tour). - When a Customer receives a booking confirmation from Schauplatz after execution of the agreement, Customer must pay the Tour fee in full no later than 60 days prior to departure (Start of the Tour). The participants added to the participant list for a Tour will be counted in the order Schauplatz receives the full payment of the Tour fee.
- If a Customer fails to pay the full Tour fee at the latest 60 days prior to departure, Schauplatz may cancel the applicable agreement. In this case, Schauplatz shall not return the contract deposit in Paragraph 2.
- Customers shall pay the Tour fee by bank transfer or international credit card.
- If any insurance premium for the Customer is included in the Tour fee, Schauplatz shall provide the customer with insurance policy which bears the name of the insurer and a description of coverage.
Article 12 Modification of the Tour Terms & Fee Adjustments
- Tour terms (Articles 1–11) may be modified in the following cases:
Ⅰ. Minimum number of participants is not met;
Ⅱ. Unforeseen local circumstances beyond Schauplatz’s control (e.g. guide unavailability, transport/fuel tax changes, new or increased taxes, currency fluctuation of more than 2%);
Ⅲ. Transport/accommodation fees increase or decrease by 5% or more, or the exchange rate changes by 2% or more from the contract date. In such cases, customers may need to pay or be refunded the difference. - If major terms (destination, dates, content, etc.) change, Schauplatz will:
Ⅰ. Notify the customer at least 15 days before departure.
Ⅱ. Offer options: alternative arrangement, refund (minus non-recoverable costs), or rebooking. - If Tour fees increase by 5% or more, Schauplatz will:
Ⅰ. Notify the customer at least 15 days before departure.
Ⅱ. Customers have 5 days to cancel. No response means the customer accepts the new price. - Refund/settlement timing:
Ⅰ. Changes before departure: settled at least 10 days before departure.
Ⅱ. Changes during the Tour: settled within 10 days after the Tour ends. - For changes or cancellations under Articles 13 or 14, the same settlement timing in (④) applies.
- A Customer who does not receive the services included in the Tour fee (such as accommodation, meals, tour, etc.) because of a cause attributable to him/herself after departure may not claim a refund of the applicable portion of fee.
Article 13 Cancellation of Agreement before Departure

Exceptions may apply in case of:
①Force Majeure Events: Natural disasters, political instability, or other events beyond control that prevent travel.
②Health-Related Issues: With proper documentation, medical conditions may allow for a more flexible cancellation policy. - Other Cancellation RightsEither party may cancel the Agreement before departure for the reasons below:
Ⅰ. Reasons for which Schauplatz can cancel this Agreement:
– a. When it is acknowledged that a customer has caused trouble for other customers or significantly interrupted successful implementation of the Tour;
– b. When a customer cannot participate in the Tour because of his/her physical condition, such as illness;
– c. When a customer fails to pay the Tour fee as prescribed by Paragraph 3, Article 11 above; or
– d. When a force majeure event (such as an act of God, extreme weather conditions, etc.) occurs.
Ⅱ. Reasons for which a Customer can cancel this Agreement:
– a. When a relative of the customer within 3 degrees of kinship, or his/ her spouse has died, provided that the customer provides death certificate or other evidence.
– b. The Tour cannot be implemented as scheduled and stipulated in the Agreement due to a cause attributable to Schauplatz.
How to Cancel
To initiate a cancellation, please notify us in writing (via email or text) with your cancellation request. We will process the cancellation and inform you of the applicable penalties based on the timing outlined above.
Article 14 Termination of Agreement after Departure
- Schauplatz or a Customer may terminate this Tour Agreement after departure for unavoidable causes. However, the terminating party must compensate the other party for any damages suffered. In this case, the amount of damages arising from such termination and not prescribed in this Agreement shall be determined as prescribed by the Consumer Dispute Resolution Standards announced by the Fair Trade Commission of the Republic of Korea.
- Provided that this Agreement is terminated as prescribed in Paragraph 1 above, Schauplatz shall assist the applicable customer in returning to his/her home. In this case, any costs incurred for such return but not attributable to Schauplatz shall be paid by the customer.
Article 15 Start and End of Tour
The Tour begins at the designated meeting point as specified in the Tour Plan, either at the airport (if pickup is provided) or another agreed location. It ends upon arrival at the final destination as outlined in the Tour Plan. Services beyond these points are not included.
Article 16 Obligation to Explain
Schauplatz must explain the major details and their amendments herein in a way the customer can understand.
Article 17 Insurance
Schauplatz must subscribe for an insurance plan or mutual aid or deposit security money for business to indemnify the customer for any damage suffered by the Customer in relation to the Tour.
Article 18 Miscellaneous
- Tours to areas with special circumstances may warrant a different agreement.
- These terms and conditions also apply to any modifications made to the booking.
- In the event of extreme circumstances or service provider-imposed conditions that significantly differ from those stated, the terms outlined in the offer or order confirmation shall take precedence.
- Late arrival, failure to appear at the start of the trip, or presenting invalid travel documents do not entitle the Customer to a refund. This applies even if Schauplatz has issued tickets or other services. If the Customer fails to check in for an air travel package, 100% of the trip cost will be retained.
- Travel and cancellation insurance is strictly non-refundable, regardless of the cancellation date. The effective date of cancellation or modification is determined by the receipt of the Customer’s written notice at the booking office. For cancellations on weekends or public holidays, the next working day applies.
- If a dispute exists over any matter not prescribed herein or interpretation hereof, Schauplatz and the customer shall settle the matter through mutual agreement. If the parties fail to reach such an agreement, applicable law and general business practices shall apply.
- In the event of any discrepancy between the English and German versions of the contracts, the English version shall prevail.
This Agreement has been created based on the standard agreement template of the Fair Trade Commission of the Republic of Korea.

Agreement on Use of Website and Privacy Policy
Article 1 Purpose
The Purpose of this Agreement is to prescribe: various services that SCHAUPLATZ LTD (“Schauplatz”), whose purposes are life, travel and photography, provides through its Internet Homepage; and the rights and obligations of the users of said Homepage.
Article 2 Definitions
- “Life” refers to the classification of special services Schauplatz plans and provides to its Customers for a special experience, such as workshops, tours, events, exhibitions, photo shoots and photo colloquiums.
- “Photography” refers to photography in a narrow sense, which means a classification, such as photo workshops and visual experiences.
- “Photo Tour” refers to a special tour where one may share the philosophy of Schauplatz on life and photography.
- “Travel” shares a definition similar to the workshop, not being the same as the Photo Tour.
- “Customer” refers to a person who uses or wishes to participate in Courses, workshops, Photo Tours, etc. provided by Schauplatz.
- “Homepage” refers to a virtual sales outlet configured by Schauplatz to provide goods and services (“Goods, Etc.”), using IT devices, including computers, so that goods, etc. can be transacted.
- “Member” refers to a person who has provided personal information to the Homepage to be registered as a Member, who is allowed to continuously receive information from Schauplatz and use various services provided by the Homepage.
- “Non-Member” refers to a person who uses services provided by Schauplatz without being registered on the Homepage as a Member.
- “User” refers to all persons, including Members and Non-Members, who use the Homepage.
- “Purchase Request” refers to a request for the purpose of entering into an agreement on the service or services Schauplatz provides.
Article 3 Stipulation, Explanation and Amendment of Provisions
- Schauplatz shall post: this Agreement, name of business; name of representative; address of business office (including the address of location where complaints of Customers are handled); telephone number, fax number, e-mail address; business registration number; telecommunication sales report number; name of the Private Information Manager; etc. in the initial service screen (full screen) of the Homepage, in a manner easily understandable by Users. Users can peruse the provisions of this Agreement in a screen linked to the initial service screen.
- Schauplatz shall seek the agreement of Users by disclosing material information, such as withdrawal of subscription, terms of refund, etc., via a separate linked or pop-up screen in a manner that Users can understand, before Users agree to this Agreement to use the Homepage.
- Provided that Schauplatz amends this Agreement, Schauplatz shall announce (the amended Agreement) in the initial screen of the Homepage by stipulating the effective date and reason for amendment and together with the current Agreement, from 7 days to 1 day before the effective date of the amended Agreement. Provided, however, that this Agreement is amended in a manner unfavorable to Users, (the amended agreement) shall be announced with a grace period of at least 30 days. In such a case, Schauplatz shall clearly compare the Agreement before and after amendment, so that Users can easily understand the differences.
Article 4 Provision and Change of Service
- Schauplatz shall engage in the followings:

- provision of information on Goods, etc. and execution of agreements;
- delivery or rendering of Goods, etc. for which agreements are executed; and
- other businesses Schauplatz undertakes.
- Provided that the quality or technological specification of Goods, etc. is altered, Schauplatz may modify the Goods, etc. to be provided under the agreement to be executed in the future. In such a case, (Schauplatz) shall immediately announce such modified Goods, etc. and date of provision thereof in the location where the description of current Goods, etc. is posted.
Article 5 Suspension of Service
- Schauplatz may temporarily suspend the provision of services when repairing, inspecting or replacing IT facilities, when IT facilities malfunction or when telecommunication service is interrupted.
- Provided that Schauplatz becomes unable to provide services because it has changed or abandoned its businesses, or has been merged with another entity or entities, Schauplatz shall inform Users of such suspension of services as prescribed by Article 8 hereunder and compensate Users under the terms originally offered by Schauplatz.
Article 6 Membership Subscription
- A User shall subscribe for membership by indicating his/her agreement to this Agreement after entering his/her personal information in the subscription form of Schauplatz.
- Schauplatz shall register the User who subscribed for membership as prescribed by Paragraph 1 above, unless he/she falls under any of the following conditions:
- when the subscriber had lost his/her membership before under Paragraph 3, Article 7 of this Agreement, with the exception of those who had lost his/her membership under Paragraph 3, Article 7 of this Agreement, 3 years have passed since the date of loss and Schauplatz has accepted his/her new membership subscription;
- when the subscriber provides false information, fails to provide certain information or provides misspelled or otherwise erroneous information; or
- when Schauplatz determines that registration of the subscriber as a Member poses significant technical difficulty to Schauplatz.
- The subscriber shall become a Member when Schauplatz’s acceptance reaches the subscriber.
- When the information provided for registration under Paragraph 1, Article 15 is changed, the Member must inform Schauplatz of the changed information using email or other methods.
Article 7 Withdrawal from and Loss of Membership
- A Member may request for withdrawal from membership to Schauplatz at any time, and Schauplatz shall immediately carry out the withdrawal process.
- In any of the following cases, Schauplatz may restrict or suspend a Member’s membership privileges:
- provision of false information during subscription;
- failure to pay for Goods, Etc. purchased using Schauplatz or failure to repay the debt of a Member occurred with regard to his/her use of Schauplatz;
- presenting a threat to the order of electronic commerce, such as interrupting Schauplatz from providing its services to others or misappropriating Schauplatz’s information; or
- commission of an act prohibited by this Agreement or the law, or an act against sound public order and customs.
Article 8 Notice to Members
- Schauplatz may notify a Member via the email address designated by the Member and agreed upon with Schauplatz in advance.
- Schauplatz may replace its notice to unspecified individuals with a posting on its bulletin board for a week or longer. However, Schauplatz shall notify each Member, if the subject of the notice has a material effect on the Member’s transaction.
Article 9 Purchase Request
Users shall request for the purchase of Goods, etc. on the Homepage using the following methods or other method similar thereto, and Schauplatz shall provide the details of each of the following when Users make the request in a way that Users can easily understand. Provided that a User is a Member, Sub-paragraphs 2 through 4 may not be applicable:
- searching for and selecting Goods, etc.;
- entering name, address, telephone number, email address (or mobile phone number), etc.;
- terms of agreement for each product, service of which subscription withdrawal right is limited and confirmation of matters related to cost;
- agreement to this Agreement and indication of acceptance or rejection of Sub-paragraph 3 above (e.g. via mouse click);
- purchase request for Goods, etc. and confirmation thereof or agreement to Schauplatz’s confirmation; and
- choice of payment method.
Article 10 Receipt Confirmation Notice and Modification and Cancellation of Purchase Request
- Schauplatz shall provide a receipt confirmation notice for a User’s Purchase Request.
- The User who received the receipt confirmation notice may request for the modification or cancellation of the Purchase Request, provided that there is a non-conforming indication. Provided, however, that the User has already made a payment, Article 15 on withdrawal of subscription shall apply.
Article 11 Establishment of Agreement
- Provided that a Purchase Request in Article 9 above falls under any of the following conditions, Schauplatz may not accept such request.Provided, however, that a minor enters into an agreement without the consent of his/her legal guardian, the minor or his/her legal guardian may cancel the agreement:
- when the Purchase Request contains any false information, fails to provide certain information or contains misspell information; or
- when Schauplatz determines that accepting a Purchase Request poses a significant technical difficulty to Schauplatz.
- Once Schauplatz’s acceptance is delivered to the User in the form of a receipt confirmation notice under Paragraph 1, Article 10 above, the User shall deposit an amount equal to 10% of the entire amount to be paid for purchase of Goods, etc. within 1 day of the date of receipt cofirmation notice. The agreement shall be deemed established when the deposit is paid.
- Indication of Schauplatz’s acceptance must contain: confirmation of the User’s Purchase Request; whether the requested item is available for sale; information regarding modification or cancellation of Purchase Request; etc.
- The User shall pay the entire fee for his/her purchase of Goods, etc. no later than 5 days after payment of the deposit. Provided that a User fails to pay the full amount within the above period, Schauplatz may cancel the applicable agreement. In this case, Schauplatz shall not return the deposit in Paragraph 2.
Article 12 Payment Method
Fees for Goods, etc. purchased from the Homepage can be paid in any of the following methods available.However, Schauplatz may not additionally impose any amount of money under whatsoever title onto the fee to be paid for the purchase of Goods, etc. with regard to the payment method chosen by Customer:
1. on-line bank transfer; or
2. cash payment on site, such as the business location of Schauplatz.
Article 13 Cancellation of Agreement when Minimum Participation is Not Met

- When offering intangible programs, such as workshops, training, city tours, etc., to the User, Schauplatz may cancel the program or modify its schedule and contents, when the minimum number of participants for the program has not been met.
- Provided that Schauplatz cancels the program or modifies its schedule and contents because the minimum number of participants has not been met, Schauplatz shall make an appropriate notice to the Customer no later than 10 days before the day of the applicable program. In such a case, the Customer may change his/her program to another program or cancel the applicable agreement. However, provided that a customer wishes to continue with his/her originally chosen program, he/she must inform Schauplatz of such a wish. Upon receipt of such a wish, Schauplatz may make a new offer to the customer.
- Provided that Schauplatz cancels an agreement after making the notice prescribed in the above Paragraph within the due date, the Customer may recover the deposit or the entire amount of the fee he/she has paid. However, the Customer may not make a claim for any compensation for other damages.
Article 14 Withdrawal of Subscription and Refund
- Provided that Schauplatz cannot provide a program that the Customer has subscribed for, such as a workshop, because the maximum number of participant had been met, Schauplatz shall immediately explain to the Customer why it cannot provide the program, and if Schauplatz has received payment in advance, Schauplatz shall return the fee or make necessary arrangements to return the fee no later than 2 business days from the date of receipt of fee.
- Schauplatz’s Terms of Photo Tour shall apply to the tour products.
- A Customer may withdraw his/her subscription for a workshop or training course due to change of heart. In such a case, the fee shall be refunded as follows:
- more than 31 days remaining from the date of the workshop or training course: the deposit or the full amount of fee except for a KRW 50,000 charge; or
- 31 days or less remaining from date of program: no refund allowed.
Article 15 Protection of Personal Information
- Schauplatz will try to protect the personal information of Members as prescribed by applicable laws and regulations, including the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. Related laws and the personal information handling policy of Schauplatz will apply to the protection and use of personal information. However, the personal information handling policy of Schauplatz does not apply to the sites linked to the Homepage of Schauplatz.
- Schauplatz complies with the personal information valid period policy prescribed by the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. Schauplatz will carry out its policies aimed at protecting personal information by destroying under a certain procedure or separately storing and managing the personal information of Customer who does not use Schauplatz’s IT service for one year.
- Schauplatz shall not use the personal information provided by Members for the purpose other than prescribed in this Agreement without the consent of Members or provide personal information to a third party for an arbitrary purpose beyond the scope of providing services to Members.
Article 16 Transmission and Provision of Information
- Schauplatz may provide Members various information deemed necessary for the Members while they are using the Homepage by posting such information on bulletin boards or by sending emails. Members may refuse to receive email (except for emails containing information related to transactions or answers to Customers’ questions, as prescribed by applicable laws) at any time.
- When Schauplatz intends to transmit the information prescribed in Paragraph 1 above by telephone or fax, it shall do so by acquiring the prior consent of the applicable Member. However, this Paragraph shall not apply to replies containing information on Members’ transactions and answers to Customers’ questions.
Article 17 Obligations Regarding Members’ IDs and Passwords
- Members are obligated to take care of their IDs and passwords.
- Members shall not allow any third party to use their IDs or passwords.
- Provided that a Member discovers that his/her ID or password has been stolen or used by a third party, he/she shall immediately inform Schauplatz and follow Schauplatz’s instructions.
Article 18 Obligations of Users
Users shall not:
1. register false information when making subscriptions or changes;
2. steal information of others;
3. modify information posted by Schauplatz;
4. transmit or post information (such as computer programs) other than the information designated by Schauplatz;
5. infringe upon the intellectual property, such as copyright, of Schauplatz or any third party;
6. defame the honor of or interrupt businesses of Schauplatz or any third party; or
7. disclose or post obscene or violent messages, images, voice recordings or any other information that is against the public order and good morals when using the Homepage.
Article 19 Relationship Between the Homepage and Linked Sites
- When the Homepage is connected to its sub-homepage (website) using hyperlinks (created in the form of text, image or moving image) or other methods, the former shall be referred to as the Homepage and the latter shall be referred to as the “Sub-homepage”.
- Schauplatz bears no obligation whatsoever for the transactions of Users made through the Sub-homepage, provided that a notice which declares that the ‘Homepage has no obligation to guarantee the transaction Customer engages in with the Sub-homepage regarding the Goods, etc. provided by the Sub-homepage’ is expressed through the initial screen of the Sub-homepage or pop-up window displayed at the time of connection thereto.
Article 20 Ownership and Restrictions on Copyright
- Copyright and other intellectual property of the works of Schauplatz posted on the Homepage belongs to Schauplatz.
- Users may not use trade the name or symbols of Schauplatz without the consent of Schauplatz.
- Customers shall not use or allow any third party to use information of which intellectual property right is owned by Schauplatz such as those acquired while using the Homepage, such as designs, layout, shapes, graphics, etc., for the purpose of gaining profit by copying, transmitting, publishing, distributing, broadcasting or by any other method without the prior approval of Schauplatz.
- Provided that Schauplatz uses the copyright of a Customer under an agreement, Schauplatz shall inform the applicable Customer of such use.
- Users shall be fully liable for any damages arising from the User’s use of information posted by Schauplatz without subscribing for program and entering into a service use agreement.
- Schauplatz does not guarantee accuracy, completeness or appropriateness of information or data it provides through the Homepage.
- Customers bear the responsibility for checking any information and issues related to Goods, etc. Schauplatz provides through its Homepage and the goods, programs etc. that Customers subscribe to are identical.
- Schauplatz bears no obligation whatsoever on the content or products of the Sub-homepage hyperlinked to Homepage.
Article 21 Member’s Postings and Copyright
- “Postings” shall refer to texts, photos, files and links Members post while using the services of Schauplatz.
- Provided that Postings of Members cause any damage or other problems, the applicable Member shall be liable for such damages or problems and Schauplatz shall not be liable in any way.
- Schauplatz may arbitrarily take action, such as posting, suspending, modifying, deleting, moving or denying register, any of the following Postings without prior approval of the Member when the Postings:
– insult or defame other Members or a third party;
– distribute or link to content that are against public order and good customs and manners;
– encourage illegal copying or hacking;
– infringe upon a third party’s copyright, and Schauplatz was asked to suspend posting of the Postings;
– are for-profit advertisements;
– are objectively deemed to have been connected to criminal or illicit activities;
– infringe upon the rights, such as copyright, of other Customers or third parties;
– are of private political decision or religious opinion, which Schauplatz deems inappropriate for the nature of its service;
– violate the principles on Postings prescribed by Schauplatz or does not correspond to the nature of bulletin board; or
– are deemed to be in violation of applicable laws and regulations.
- Copyright of Postings posted by Members belongs to the Members who posted the Postings. However, Schauplatz may use the Postings of Members without any separate consent of the Members and free of charge for the purposes of operating, exhibiting, transmitting, distributing and promoting its service in compliance with fair practices prescribed by the laws related to copyright.
- Provided that Schauplatz wishes to use the Postings of a Member in a way other than those provided in Paragraph 4 above, Schauplatz shall acquire the Member’s prior consent by telephone, fax, email, etc.
- Even if a Member terminates his/her Agreement, the Postings that have been re-posted or copied by others who stored such Postings; provided them in combination with others’ Postings; or registered in common bulletin boards will not be deleted.
Article 22 Jurisdiction and Governing Law
- Any lawsuit related to a dispute on electronic commerce arising between Schauplatz and a Customer shall be brought to an exclusive jurisdiction of a local court that has jurisdiction over the location of Schauplatz’s place of business.
- Laws of the Republic of Korea shall apply to an electronic commerce lawsuit raised between Schauplatz and Customer.

The purpose of providing translations of the contracts and guidelines is not to create a legally binding agreement and the translations are not a substitute for the legal validity of the Korean versions. In the event of contradictions or conflicts, the Korean version shall always prevail over the provisions in other languages.
